Acceptance of Terms

By accessing or using PawTimer, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, please do not use the application.

Eligibility

You must be at least 13 years old to use PawTimer, and at least 18 years old, or have the consent of a parent or guardian, to purchase a subscription. By using the app you confirm that you meet these requirements.

Description of Service

PawTimer provides tools for tracking and managing pet care activities, including walk recording, reminders, activity scoring, record keeping, and written insights. We may modify, suspend, or discontinue any part of the service at any time. We will give reasonable notice of changes that materially reduce functionality you have paid for.

License to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use PawTimer on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse engineer, decompile, rent, resell, or create derivative works from the app except to the extent this restriction is prohibited by applicable law.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.

Account deletion: you may delete your account at any time through the app's settings. Deletion permanently removes your personal data, pet profiles, activity records, uploaded media, and generated insights from our servers, and cannot be undone.

User Content

You retain ownership of the content you submit to PawTimer, including pet records and photos. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content solely to operate and provide the service to you. This licence ends when you delete the content or your account, except for copies retained briefly in backups.

You are responsible for having the rights to any content you upload, and for ensuring it does not infringe the rights of others.

Accuracy of Information

The reminders, scores, and insights PawTimer produces are calculated from the information you enter. If records are incomplete, outdated, or inaccurate, the output will be too. You are responsible for keeping your pet records accurate and for verifying anything important with your veterinarian or another qualified professional.

Prohibited Conduct

You agree not to use PawTimer for any unlawful purpose, nor in any way that could damage, disable, or impair the service. You agree not to attempt to gain unauthorised access to any part of the service, to interfere with other users, to scrape or bulk-extract data, or to use the app to develop a competing product.

Intellectual Property

PawTimer and its original content, features, and functionality are owned by PawTimer LLC and are protected by copyright, trademark, and other intellectual property laws. All rights reserved. If you send us feedback or suggestions, you grant us an unrestricted right to use them without obligation to you.

Subscription Terms

PawTimer offers premium subscriptions with automatic renewal. Subscriptions renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. Payment is charged to your Apple ID at confirmation of purchase. Except where required by law, we do not provide refunds for unused portions of a subscription period. Prices may change, and we will give notice before a change affects a renewal.

Health Information

PawTimer is a record-keeping and activity-tracking tool. It is not a medical device and does not provide veterinary, medical, or diagnostic services.

The PAW Score, insights, summaries, and any suggestions in the app, including text generated with the assistance of AI, are informational only. They are derived from the activity and care records you enter, may be incomplete or inaccurate, and must not be relied upon to assess your pet's health or to make care decisions.

Always consult a licensed veterinarian for any question about your pet's health, diet, medication, or treatment, and never delay seeking professional care because of something you read in this app. If you believe your pet needs urgent attention, contact a veterinarian immediately.

AI-Generated Content

Some text in the app is generated by an artificial intelligence model from a summary of your pet records. AI-generated text can be wrong, incomplete, or misleading, and it is not reviewed by a person before you see it. Treat it as a prompt to think, not as a professional recommendation, and do not rely on it for decisions about your pet. Our Privacy Policy explains what information is sent to produce it.

Disclaimer of Warranties

PawTimer is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, that location or distance measurements will be accurate, or that any result produced by the app will be correct. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, PawTimer LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any loss of data, profits, or goodwill, arising out of or relating to your use of the service, including any harm to a pet. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or twenty US dollars. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

Indemnification

You agree to indemnify and hold harmless PawTimer LLC and its officers, employees, and agents from any claim, demand, loss, or expense, including reasonable legal fees, arising out of your use of the service, your content, or your breach of these Terms.

Termination

You may stop using PawTimer at any time and delete your account in the app. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. On termination, the provisions of these Terms that by their nature should survive, including intellectual property, disclaimers, limitation of liability, and indemnification, will continue to apply.

Dispute Resolution and Arbitration

Please read this section carefully. It requires most disputes to be resolved by individual arbitration rather than in court, and waives your right to join a class action.

Before starting arbitration, email support@pawtimer.com so we can try to resolve the matter. If it remains unresolved after 30 days, either of us may begin binding arbitration before the American Arbitration Association under its Consumer Arbitration Rules, governed by the Federal Arbitration Act. Arbitration is conducted remotely unless you request a hearing, in which case it is held where you live or somewhere we both agree on. Fees are allocated as those rules provide, and the arbitrator may award the same individual relief a court could.

You and we agree to bring claims only in an individual capacity, and not as part of any class, collective, consolidated, or representative proceeding. An arbitrator may not consolidate claims or preside over a representative proceeding. If 25 or more similar claims are brought by or with the help of the same counsel, those claims may be grouped into batches. If this paragraph is unenforceable for a particular claim, only that claim proceeds in the courts identified under Governing Law.

Either of us may instead bring a qualifying individual claim in small claims court, or ask a court for an injunction to protect intellectual property. This section does not apply where local law does not permit binding pre-dispute consumer arbitration, including the European Economic Area and the United Kingdom, and nothing in these Terms waives rights you have under mandatory local consumer law.

Apple App Store Terms

These Terms are between you and PawTimer LLC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance, or consumer protection claims. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government restricted party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to Terms

We may modify these Terms at any time. We will post the updated Terms and change the "Last Updated" date above, and where the changes are significant we will give notice in the app. Continuing to use PawTimer after changes take effect means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. Subject to the Dispute Resolution and Arbitration section above, you and we agree to the exclusive jurisdiction of the state and federal courts located in Albany County, New York, except where mandatory local consumer law gives you the right to bring proceedings in your own place of residence.

General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
